Depending on how you access this website, you may incur data charges from your internet or mobile service provider. Fiddletrain Media, LLC is not responsible for any charges you receive due to your use of this website.

By creating a user account, you agree to receive (i) an email which will be sent you shortly after the creation of your account which confirms your registration and (ii) receiving periodic email communications providing you with certain information and discount membership offers relevant to your subscription. 5. Limitations

In no event shall Fiddletrain Media, LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Fiddletrain Media, LLC’s Internet site, even if Fiddletrain Media, LLC or a Fiddletrain Media, LLC authorized representative has been notified orally or in writing of the possibility of such damage. Our goal is to maintain a stable website so you can learn whenever is most convenient for you. However, occasionally, due to factors beyond our control, website content may occasionally be unavailable for a period, e.g., our website hosting service is undergoing maintenance or your internet service provider is experiencing a service interruption. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

6. Membership Renewal, Term and Fees

This Agreement, including all subsequent revisions, shall remain in full force and effect each and every time you use the website. Either party may terminate this Agreement at anytime with or without cause. Fiddlevideo.com repeating membership is based on a 30-day, 90-day or 365-day automatically renewing cycle depending on the pricing plan that you choose during sign-up. See Lifetime Plan terms below for details related to one-time fee lifetime access.

Billing

  • Recurring Billing. When you sign up for a repeating Fiddlevideo membership, you authorize us to automatically renew your subscription at the end of the term of the subscription you purchased (and each subsequent term) for the same term length of the subscription you initially purchased.
  • Billing Cycle. Unless you cancel your repeating membership as described below, at the time of each such renewal you authorize us to charge your designated payment method at the then-current, non-promotional price (unless otherwise stated in the offer you accepted) for the renewal of your subscription.
  • No Refund. All fees relating to Fiddlevideo.com membership, including the initial and any subsequent automatic renewal payments, are nonrefundable. You must cancel your Fiddlevideo.com subscription before it renews at the end of your current billing period in order to avoid the next billing. If you cancel your subscription, the cancellation will be effective at the end of the current billing period. We do not offer prorated refunds or credits for any portion of the subscription fee for a cancelled subscription. All requests for an exception must be submitted in writing to info@fiddlevideo.com. No refunds will be given if the subscriber has filed a dispute or charge-back with their payment provider or there is indication of continued use of the site’s video lessons or other material provided on the site. The amount and form of any credit or refund and the decision to provide them are at Fiddletrain Media, LLC’s SOLE AND ABSOLUTE discretion. A 10% service charge will be applied to any exceptions granted to the No Refund policy.
  • Membership Cancellation. You may terminate this Agreement at anytime by simply going to the tab labeled “Account” on the website and selecting “Cancel” on your active subscription. Or if you prefer, you may email us at info@fiddlevideo.com, and we can cancel your membership for you. If you cancel your subscription, your access to paid, members-only content will expire at the end of your current billing period (you will continue to have access to the Fiddlevideo.com service through the end of your current billing period).
  • Lifetime Membership. A Fiddlevideo Lifetime Membership is purchased with a single fee (does not involve repeated billing charges). Lifetime Membership is valid as long as www.fiddlevideo.com continues to offer online fiddle lessons. Subscribers who purchase a Lifetime Membership will automatically be granted access to all new fiddle instructors added to the website in the future and all new lessons released by fiddle instructors already featured on the website.

7. Revisions and Errata

The materials appearing on Fiddletrain Media, LLC’s web site could include technical, typographical, or photographic errors. Fiddletrain Media, LLC does not warrant that any of the materials on its web site are accurate, complete, or current. Fiddletrain Media, LLC may make changes to the materials contained on its web site at any time without notice. Fiddletrain Media, LLC does not, however, make any commitment to update the materials.

8. Links

Fiddletrain Media, LLC has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Fiddletrain Media, LLC of the site. Use of any such linked web site is at the user’s own risk.

9. Site Terms of Use Modifications

Fiddletrain Media, LLC may revise these terms of use for its web site at any time without notice, and such modification shall be effective upon posting on the website. By using this web site you agree to be bound by the then current version of these Terms and Conditions of Use.

10. Forum Use

As a forum user, you agree to abide by the following Terms and Conditions of Use:
Your membership, including any remaining balance of payment for site access may be forfeited if you post unlawful, harmful, offensive, threatening, abusive, libelous, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable comments. The Operators may, but are not obligated to, monitor or review any areas on the Website where users transmit or post communications or communicate solely with each other, including but not limited to user forums and email lists, and the content of any such communications. You are strictly prohibited from communicating on or through the Website any unlawful, harmful, offensive, threatening, abusive, libelous, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable material of any sort, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.

You are expressly prohibited from compiling and using other Users’ personal information, including addresses, telephone numbers, fax numbers, email addresses or other contact information that may appear on the Website, for the purpose of creating or compiling marketing and/or mailing lists and from sending other Users unsolicited marketing materials, whether by facsimile, email, or other technological means.

You also are expressly prohibited from distributing Users’ personal information to third-party parties for marketing purposes. The Operators shall deem the compiling of marketing and mailing lists using Users’ personal information, the sending of unsolicited marketing materials to Users, or the distribution of Users’ personal information to third parties for marketing purposes as a material breach of these Terms and Conditions of Use, and the Operators reserve the right to terminate or suspend your access to and use of the Website and to suspend or revoke your membership in the consortium without refund of any membership dues paid.

The Operators note that unauthorized use of Users’ personal information in connection with unsolicited marketing correspondence also may constitute violations of various state and federal anti-spam statutes. The Operators reserve the right to report the abuse of Users’ personal information to the appropriate law enforcement and government authorities, and the Operators will fully cooperate with any authorities investigating violations of these laws.

Material you create on or upload to this site including comments, threads, topics, replies, profile avatars, etc. may be visible to other subscribers and the general public.

11. Disputes Between Users

The resolution of disputes that may arise between users is the sole responsibility of the users, and Fiddletrain Media, LLC has no liability or obligation with respect to any such disputes.

12. Force Majeure

Neither party shall be liable for, or considered in breach of these Terms and Conditions of Use on account of, any delay or failure to perform as a result of any causes or conditions which are beyond such party’s reasonable control including without limitation, fire, acts of God, riots and insurrections, strikes, boycotts or lockouts, embargoes, judicial action, lack of or inability to obtain resources, power or communication failures and acts of civil or military authorities.

13. Governing Law

Any claim relating to Fiddletrain Media, LLC’s web site shall be governed by the laws of the State of Oregon without regard to its conflict of law provisions.
